Mediation and Negotiation Part 2: Mediation - Benefits and Insights

Mediation is frequently referred to as a form of alternate dispute resolution (ADR). Based upon my experience as ex-litigator turned mediator (having mediated over 1000 matters), I am a strong believer that mediation should be referred to as appropriate dispute resolution and considered the primary dispute resolution tool. It provides parties a safe place to have difficult conversations, an opportunity to determine their own dispute in a way that is confidential, creative, commercial, and cost effective.

To find out more about the many benefits of mediation, watch my second video here:

Do you know how to have difficult conversations well or do you try to avoid them?  Why is it important to know how to have difficult conversations? How are current market pressures impacting disputes?

I’m excited to launch the first video in my Mediation and Negotiation series where I begin to explore the answers to these questions.

One of my favourite tips from this video is: When preparing for a successful negotiation it is important to remember that we never really know what’s going on for the other party/negotiator.
